Article 1 - Scope of application
The present general conditions of sale (hereinafter referred to as the "General Conditions") apply without restriction or reservation to all sales concluded between the company Chabi chic, the seller on the one hand, SARL with a capital of 10 000dhs, whose registered office is located at 322 route principale, zone industrielle Sidi Ghanem 40 000 Marrakech Morocco, under the Trade Register number 59041, and any user (hereinafter referred to as the "Customer") of the site www.chabi-chic.com (hereinafter referred to as the "Site") wishing to place a professional order.
These General Terms and Conditions of Sale are accessible at all times on the Site and shall prevail, where applicable, over any other version or any other contradictory document. These terms and conditions of sale are subject to change. Chabi Chic reserves the right to modify its terms and conditions of sale at any time without prior notice to the Customer. The modified general terms and conditions of sale are opposable to the Customer as from and for the duration of their on-line publication for products ordered after their on-line publication. Each purchase on the Site is subject to all the clauses of the general terms and conditions of sale applicable on the date the order is placed.
The Customer will be able to validate his order only after having taken knowledge of the present general conditions and having accepted them by notching the box dedicated to this effect. Chabi Chic considers that by validating his/her order, the Customer has duly read the general sales conditions and accepts them unreservedly. The terms and conditions applicable and enforceable against the Customer are those in force at the time of the Customer's effective validation of the order recorded on the Site. These terms and conditions of sale apply to the exclusion of all other terms and conditions, in particular those applicable to in-store sales or sales via other distribution and marketing channels.
Article 2 - Purpose
The Site allows "Chabi Chic" to offer for sale handicrafts and decorative items, perfumed scents, small furniture, cosmetics, delicatessen and any other item designed and created by and for Chabi Chic. ADIA Chabi Chic is a registered trademark protected by Moroccan law. Chabi Chic SARL can in no way be held responsible for any misuse that third parties may make of it by using the name "chabi-chic.com" to put the right URL. The present general conditions of sale are therefore intended to govern:
- the organization of legal relations between Chabi Chic and the Customer.
- the terms of sale between Chabi Chic and the Customer (order, delivery, etc.).
Article 3 - Products
The products offered for sale by Chabi Chic are those listed on the site, on the day the user consults the site and within the limits of available stocks. In case of unavailability of one of the products, the buyer will be informed as soon as possible. The photographs and texts illustrating the products are not contractually binding. Chabi Chic cannot be held responsible for any errors in these photographs and/or texts.
The Vendor offers hand-made items (textiles, ceramics, baskets, wooden utensils, jewelry, etc.), which may vary in color, shape, finish and discoloration. These variations cannot be considered defects, as they are related to the hand-made nature of the items, which makes them unique.
Article 3 - Prices
Prices are quoted in euros, inclusive of VAT and exclusive of delivery charges, which are payable by the customer unless otherwise stated. Any order placed on the site and delivered outside Morocco may be subject to taxes and customs duties, which are imposed when the parcel reaches its destination.
Chabi Chic is not obliged to check and inform the buyer of any applicable customs duties and taxes. These duties and taxes do not apply to France or Central Europe, as the goods purchased already benefit from the payment of these duties and taxes in the transport payment you will make. The prices indicated do not include delivery charges, which will be invoiced in addition and will be specified to the purchaser on the order summary, before final validation of the order.
Article 4 - Ordering procedure
4.1 - Customer identification : To place an order, the Customer must log on to the Site. The Site is accessible 24/7. For subsequent orders, the Customer may access his/her account, if he/she has created one, by entering his/her login and password. The Customer is entirely responsible for his login and password, and undertakes to keep them confidential.
4.2 - Placing an order: Customers wishing to place an order select products on the site. Once the selection has been made, the Customer must click on the validation button. The Customer's basket is thus created.
- Express delivery: The customer will be informed of the delivery method offered and the weight-based rate in effect from the country of departure. This is subject to the local shipping rates of international carriers such as Colissimo, GLS, DHL etc...
- Standard delivery: The customer will be informed of the delivery method offered and the price per weight from the country of departure. You will be contacted by email to schedule an appointment with the delivery company.
c. Payment: Once steps 1 and 2 have been validated, a transport quote is sent to the customer, including transport. If the customer validates it, a payment link corresponding to the deposit of 50% of the order is sent to the customer. Payment of purchases is made at the customer's choice: By bank transfer to the Chabi Chic bank account, whose references and bank details will be sent to the customer by e-mail. The holder of the bank account must be the person placing the order (identity of surname, first name and address).
The order will be reserved for 72 hours from the validation of the basket and will only be confirmed on receipt of the amount transferred. By credit card ( Visa, Mastercard, ) via a secure payment link that will be sent to the customer. Chabi Chic reserves the right to request proof of identity, place of residence and means of payment. Chabi Chic reserves the right to cancel any order in the absence of such proof.
Chabi Chic reserves the right to refuse to honour any order in the event of a dispute relating to the payment of a previous order. In case of unpaid whatever the motive, an amicable fixed allowance of 15 € will be required by Chabi Chic in addition to the amount of the invoice, increased by the expenses of debit invoiced by the banking establishment of Chabi Chic in the case where the amicable recovery would have remained unsuccessful within 10 days starting from the date of sending of the first mail of request for recovery, that this mail is addressed by registered mail or simple letter.
Collection will be carried out by legal means. Any costs incurred by the collection agency acting on behalf of Chabi Chic and invoiced directly to the Customer are independent of the amicable lump-sum indemnity.
d. Confirmation: The order is binding on the Customer as soon as it has been validated, subject to the exercise of the Customer's "Right of Withdrawal", which may be exercised within fourteen (14) calendar days from the date of receipt or collection of the Order. If this period expires on a Saturday, Sunday or public holiday, it will be extended to the next working day. Customers wishing to exercise their right of withdrawal must return the items within the above-mentioned period, in their original packaging, complete and new. This right of withdrawal does not apply to special orders with specific products (size, color, design) or co-branded products.
The validation of the order by the Customer and the payment of this one lead to the reception of an email of confirmation sent by Chabi Chic to the email address indicated by the Customer. The data communicated by the Customer and recorded by Chabi Chic during the registration of the order constitutes proof of the transactions between the Customer and Chabi Chic.
4.3 - Order tracking and delivery: The Customer chooses a delivery address that must be located in France or abroad. The Customer is solely responsible for any failure to deliver due to a lack of information when placing the Order. The Vendor will provide the Customer with a tracking number which will enable him/her to follow the progress of his/her order. The amount of the Delivery Costs depends on the amount of the order, the country and the delivery method chosen by the Customer. In any case, the amount of the delivery charges is indicated to the customer before the order is validated.
Delivery times may vary depending on the availability of the goods ordered. They are given in working days and correspond to the average time required to prepare and deliver the order in France. They run from the date of confirmation of the order by the seller. In the event of a delay in delivery, the seller will inform the customer by e-mail that delivery will be delayed and will give the new delivery date.
Delayed/missing delivery: We work with fast and reliable international carriers, however, as with any shipment, there may be a delay in delivery or the parcel may go astray. In the event of late delivery, the customer must inform Chabi Chic's customer service department by e-mail at [ email protected]. Chabi Chic will forward the information to the carrier to initiate an investigation. This investigation can last up to 21 days from its opening. If the parcel is found during this period, it will be returned immediately to the Buyer's home address (in most cases). If, on the other hand, the parcel is not found at the end of the 21-day investigation period, the carrier will consider the parcel lost.
In this case, Chabi Chic will send you the replacement products, at its expense. If the lost product(s) were no longer available at that time, Chabi Chic will reimburse you the amount of these products. Chabi Chic declines any responsibility as for the lengthening of the delivery periods because of the conveyor, in particular in the event of loss of the products or strike of carriers.
Receipt of order: On receipt of the order, the Buyer shall check the conformity of the Products received in execution of his order. Any anomaly concerning the delivery (damage, non-conformity, missing product compared to the delivery slip, damaged package, broken products, etc.) must be indicated on the delivery slip in the form of "handwritten reservations", accompanied by the Buyer's signature.
At the same time, the Buyer must confirm any anomaly by contacting the carrier at the time of delivery. The Buyer must send a copy of this letter by e-mail to [email protected] Unless there is a legitimate reason, any claim not brought to the attention of Chabi Chic within 21 days ?? Article 5 - Personal Data Protection
Chabi Chic undertakes not to communicate any personal data (name, address, telephone number, email address, etc.) or data relating to payment that may have been supplied to it to any third-party companies or organizations, except in the following cases: - As part of the associated services chosen by our customers (delivery, etc.) to facilitate a transaction or to resolve a possible dispute. - If required by Moroccan law. - To comply with an injunction issued by a court of law or legal authorities.

They are the exclusive property of CHABI CHIC SARL. Internet users who have a personal website and who wish to place, for personal use on their site, a simple link referring directly to the homepage of the Chabi Chic site, must request authorization from Chabi Chic SARL. However, any hypertext link to the Chabi-chic.com website using framing, deeplinking, in-line linking or any other deep-linking technique is strictly prohibited. Article 7.1 - Liability
The Chabi Chic site has only an obligation of means for all stages of access to the site, the order process, delivery or subsequent services. The site may not be held liable for any inconvenience or damage inherent in the use of the Internet, in particular a break in service, external intrusion or the presence of computer viruses, or for any event qualified as force majeure, in accordance with jurisprudence.
Furthermore, Chabi Chic shall not be held liable for any breach of its contractual obligations in the event of force majeure or fortuitous event, including, but not limited to, internal or external strike, fire, disaster, internal or external breakdown, and any event preventing the proper execution of orders. If the dispute concerns payment transactions, the bank or third party responsible for the payment system may be consulted. Chabi Chic retains full ownership of the products sold until full payment of the principal price, including taxes and charges.
Article 7.2 - Force Majeure
Chabi Chic shall not be liable for the total or partial non-performance of its obligations under the present contract, if such non-performance is caused by an event constituting force majeure, recognized as such by jurisprudence. The Parties agree that they shall consult each other as soon as possible in order to determine together how the order will be carried out during the period of force majeure. After a period of one (1) month of interruption due to force majeure, the parties will be released from their obligations to each other.
Article 7.3 - Partial invalidity
If one or more stipulations of these general terms and conditions of sale are held to be invalid or declared as such in application of a law, regulation or following a final decision by a competent court, the other stipulations will retain all their force and scope.
Article 7.4 - Entire Contract
These general terms and conditions of sale and the order summary sent to the purchaser form a contractual whole and constitute the entire contractual relationship between the parties. In the event of contradiction between these documents, the general terms and conditions of sale shall prevail.
Article 7.5 - Applicable law - Jurisdiction
The present general conditions of sale are governed by Moroccan law. For all disputes relating to the present contract between Chabi Chic and a customer, the Commercial Court of Marrakech shall have sole jurisdiction.
